DMCA & Takedown Policy

SkillFlow respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using the SkillFlow platform ("Platform"). This policy also covers takedown requests for content that violates our Acceptable Use Policy.

2. Filing a DMCA Takedown Notice

If you believe that content on SkillFlow infringes your copyright, please send a written notice to our DMCA Agent containing the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered, a representative list.
  3. Identification of the material that is claimed to be infringing, including the URL or other specific location on the Platform where the material can be found.
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

3. Our Response to Valid Notices

Upon receiving a valid DMCA takedown notice, SkillFlow will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material ("alleged infringer") that the content has been removed.
  • Provide the alleged infringer with a copy of the takedown notice and information about filing a counter-notification.

We aim to process all valid takedown notices within 2 business days of receipt.

4. Counter-Notification

If you believe your content was removed in error, you may file a counter-notification with our DMCA Agent containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original takedown notice.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we will restore the removed material.

5. AUP Violation Takedowns

In addition to copyright-related takedowns, SkillFlow will remove content that violates our Acceptable Use Policy, including but not limited to skills containing malicious code, generating harmful content, or facilitating illegal activities. AUP violation reports can be submitted via:

AUP violations are reviewed by our team and may result in immediate content removal without prior notice, especially for severe violations (malware, CSAM, fraud).

6. Repeat Infringer Policy

SkillFlow will terminate the accounts of users who are repeat infringers. A user is considered a repeat infringer if they receive three (3) valid takedown notices or AUP violation notices within a twelve (12) month period. Account termination under this policy is permanent and includes forfeiture of any pending Creator payouts.

7. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability. Please ensure that your takedown notice or counter-notification is accurate before submitting.
